These terms are a contract between you and [COMPANY LEGAL NAME] ("we") for the use of SwayFate — our website, player, stories, Season Passes and coins (the "Service"). By watching, you agree to them. If you buy something, the purchase terms in section 4 also apply.
1. Who can use the Service
You must be at least 18 years old. By using the Service you confirm that you are. The Service is offered to residents of the United States; we may make it available elsewhere, in which case any mandatory consumer protections of your country apply in addition to these terms.
2. What you get
We grant you a personal, non-exclusive, non-transferable licence to stream our stories through the Service for your own enjoyment. You may not download, copy, re-upload, publicly show, sell or otherwise distribute our content, or use it to train machine-learning systems. Short clips may be shared only through the sharing features we provide.
Our stories are works of fiction. The performers, voices and images in them are generated with artificial intelligence; the scripts, choices and editing are the work of our team. No real person is depicted. See our AI content disclosure.
3. Your choices and progress
Interactive stories remember the choices you make on the device and account you use. We may reset progress when a story is updated; where we can, we will preserve it. Different choices lead to different scenes and endings; there are no "wrong" choices, and paid options never contain information needed to understand the story.
4. Purchases
Season Pass
A Season Pass is a one-time purchase that unlocks every episode of one season, including episodes released later in that season, for as long as the season is available on the Service. It does not renew. Prices are shown before you pay and include any applicable tax or state that tax will be added.
Coins
Coins are a virtual item used to unlock individual episodes or optional premium scenes. The real-money price of each coin bundle and of each unlock is shown before you pay. Coins you have paid for do not expire while the Service operates; promotional coins we give away may have an expiry stated when granted. Coins have no cash value, cannot be transferred, and are not refundable except as described below or as required by law.
Subscriptions
We do not currently offer a subscription. If we introduce one, we will ask for your separate, express consent to its renewal terms before charging, send reminders as required by law, and let you cancel online in as many clicks as it took to subscribe.
Payments and refunds
Payments are processed by Stripe. Because our products are digital content delivered immediately, purchases are final once the content is accessible to you, except that we refund (a) duplicate charges, (b) purchases of content that fails to play for reasons on our side and that we cannot fix within 7 days, and (c) whatever else the law of your state or country requires. If you are a consumer in the EU or UK, you will be asked to expressly agree to immediate access and to acknowledge that you lose your 14-day right of withdrawal once streaming begins. 5. Accounts and the launch list
You can watch free episodes without an account. If you create one, keep your login secure and tell us about any unauthorised use. Joining the launch list means we will email you about release dates; every email has an unsubscribe link.
6. Acceptable use
Do not interfere with the Service, bypass paywalls or technical limits, scrape content, impersonate others, or use the Service for anything unlawful. We may suspend access for breaches.
7. Our content and your feedback
The Service and its content are owned by us or our licensors and protected by copyright, trademark and other laws, to the extent those laws protect them. If you send us feedback or story ideas, you allow us to use them without obligation to you.
8. Availability and changes
We may change, add or remove stories and features and may discontinue the Service. If we remove a season you have paid for before you could reasonably finish it, we will refund you or offer equivalent content. We will give at least 30 days' notice before discontinuing paid content.
9. Disclaimers and limitation of liability
The Service is provided "as is" to the extent permitted by law. We do not promise it will be uninterrupted or error-free. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or the statutory rights of consumers.
10. Disputes
